Terms of Use of the www.clovin.pl website

 

1. General Provisions and Definitions:

The terms used in this Regulation mean:

1)     Service – the website at www.clovin.pl, containing products manufactured by the Owner, along with a price list.

2)     Owner – Clovin S.A., with its registered office at ul. Zarzecze 14, 18-220, Czyżew, (KRS: 0000338658, NIP: 7221609039, REGON: 200305532).

3)     User – a person using the Service in accordance with the Regulations and possessing full legal capacity.

4)     Regulations – this Regulation specifying the manner of using the Service by Users.

 

2.  Service.

2.1. The Service is the official corporate website of Clovin S.A., where products and brands of the Owner, who is their exclusive owner and manufacturer, are made available. Products and Brands from the “Private Labels” section have been made available by the Owner based on consent given by the owner of these products or brands.

2.2. The Service in the “Downloads” tab allows the User to download: a product catalog, ingredient data sheets, advertising materials (Materials). The Owner has exclusive copyright to the Materials, in terms of their use and disposal in all fields of exploitation. Consequently, any changes made to the Materials or their use in a manner contrary to the purpose for which they were made available will constitute a violation of the Owner’s copyright.

2.3. The Service in the “Downloads” tab allows the User to download a price list, after providing a password, which will be provided to the User upon request by the Owner. In justified cases, the Owner reserves the right to refuse to provide the password, without stating a reason. At the same time, the Owner has the right to change the assigned password at any time and the right not to assign a new password. In the “Downloads” tab, an email address will also be provided to the person issuing the password and to whom additional requests can be addressed to send a product or products data sheet.

2.4. The Service redirects to external websites of the Owner, available at: www.wash-expert.pl and www.dezynfekcja-prania.pl. The use of these websites implies acceptance of separate regulations available on these websites.

3.  Industrial and Intellectual Property Rights:

3.1. The Owner has exclusive copyright to all provided Materials as well as to trademarks and product designations, subject to copyright and trademarks for Materials concerning Products and Brands from the “Private Labels” section, which the Owner uses based on agreements with the owners of these products and brands. All works and trademarks provided on the Service cannot be used without the consent and knowledge of the Owner. Using and disposing of these Materials and trademarks without the Owner’s consent violates the copyrights specified in the copyright law of February 4, 1994 (as amended).

4.  Personal Data:

4.1. The Administrator, i.e., the entity deciding how the personal data of Users who are natural persons will be used, is CLOVIN S.A., ul. Zarzecze 14, 18-220 Czyżew, NIP; 722-16-09-039 (hereinafter referred to as CLOVIN).

4.2. For matters related to personal data, please contact us:

4.3. Processing of User’s personal data will be carried out for the purpose of:
  • Registering and processing User messages,
  • Enabling technical support related to User inquiries,
  • Handling inquiries sent by the User (e.g., through the contact form).

4.4. The Service processes the following catalog of User’s personal data: First and Last Name, Email Address, Telephone, Mailing Address. If for any reason the User does not provide the above-mentioned personal data, they will not be able to submit an inquiry on the clovin.com.pl website.

4.5. The User may withdraw consent to the processing of personal data at any time. Withdrawal of consent does not affect the legality of the processing of personal data carried out based on the User’s consent before its withdrawal. The statement of withdrawal of consent to the processing of personal data should be sent to the email address: odo@clovin.com.pl or postal address: CLOVIN S.A. 18-220 Czyżew, ul. Zarzecze 14.

4.6. The User has the right to access their data and correct, delete, restrict processing, transfer, and object to processing.

4.7. The User has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the processing of their personal data violates the GDPR regulations.

4.8. User’s personal data is provided to entities supporting the Owner and the Service in providing services, in particular:
  • entities providing hosting services on our behalf,
  • entities providing SMS / Email messaging services on our behalf,
  • entities providing technical administration of the www website.

User’s data may also be provided to state authorities under the law.

4.9. User’s personal data is not transferred to countries outside the European Economic Area.

4.10. User’s personal data provided for the purpose of responding to User inquiries sent via the clovin.com.pl website, statistical, and archival purposes – are stored for a maximum period of 6 months from the date of receiving the message from the User.

4.11. Use of cookies: Cookies are collected solely for the purpose of gathering information to customize sales to individual products, individual needs, and preferences of Customers. Cookies are stored by the Internet browser on the Customer’s hard drive and do not directly serve to collect personal data. This means that the Customer can disable Cookies support in their Internet browser, but it will limit the possibility of using the Clovin Service.

5. Complaints

5.1. Complaints regarding the Service should be submitted and sent along with justification to the email address: clovin@clovin.com.pl. Complaints are considered within 14 working days from the date of receiving the complaint via email at the email address provided in the notification. The Owner’s decision on the complaint is final and there is no right of appeal.

5.2. In case of any doubts regarding the interpretation of this Regulation, the Owner has the right to make a binding interpretation of the Regulation.

5.3. The Owner reserves the right to change the Regulation. The change in the Regulation comes into effect on the day of its publication on the Service.

5.4. The Owner is not liable for:

1)   any technical problems (in particular: malfunctions of devices and computer programs providing Internet access, email operation) preventing or hindering the performance of rights and obligations specified in the Regulations,

2)    consequences of providing incorrect data by the Participant, in particular data necessary to provide a password.

5.5  Polish law applies to matters not regulated by the Regulations, in particular the provisions of the Civil Code and the Act on Copyright and Related Rights.

6. Responsibility.

6.1. Presenting products or services on the Service does not constitute an offer within the meaning of Article 66 of the Civil Code. They have been provided for informational purposes only.
